Welcome to Area Specialist Pest Solutions! These Terms and Conditions govern the provision of pest control and related services by Area Specialist Pest Solutions ("we," "us," or "our") to you, the customer ("you" or "your"). By engaging our services, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Definitions

  • "Services" refers to pest control, termite management, hygiene services, inspections, or any other services provided by Area Specialist Pest Solutions.

  • "Agreement" means these Terms and Conditions, along with any quotation, booking confirmation, or service agreement provided to you.

  • "Premises" refers to the location where the Services are to be performed.

  • "Pests" includes insects, rodents, termites, birds, and other organisms targeted by our Services.

2. Services

2.1 Scope of Services: We will provide the Services as outlined in the quotation or booking confirmation provided to you. Services may include pest inspections, treatments, preventative measures, or ongoing maintenance plans.

2.2 Service Delivery: We will perform the Services with reasonable care and skill, using trained technicians and industry-standard methods. However, we do not guarantee the complete elimination of all pests, as this may depend on environmental factors beyond our control.

2.3 Access to Premises: You must provide us with safe and unobstructed access to the Premises to perform the Services. This includes ensuring all areas requiring treatment are accessible and free of hazards (e.g., pets, children, or obstacles).

2.4 Preparation: You agree to follow any preparation instructions provided by us prior to the Service (e.g., removing food items, covering furniture, or vacating the Premises if required).

3. Bookings and Cancellations

3.1 Bookings: Services must be scheduled in advance. We will confirm the date, time, and details of your booking via phone, email, or text message.

3.2 Cancellations by You: If you need to cancel or reschedule a booking, please notify us at least 24 hours prior to the scheduled Service time. Cancellations made with less than 24 hours’ notice may incur $50 cancellation fee.

3.3 Cancellations by Us: We reserve the right to cancel or reschedule a booking due to unforeseen circumstances (e.g., weather, staffing issues, or equipment failure). We will notify you as soon as possible and offer an alternative time or a refund if applicable.

4. Fees and Payment

4.1 Quotation: We will provide you with a quotation for the Services prior to commencement. All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.

4.2 Payment Terms: Payment is due in full upon completion of the Services unless otherwise agreed in writing (e.g., for subscription plans). For pre-paid Services or subscription plans, payment must be made in advance.

4.3 Payment Methods: We accept payment via credit/debit card, bank transfer, or cash. Additional fees may apply for certain payment methods.

4.4 Late Payment: If payment is not received within 7 days of the due date, we reserve the right to charge interest at a rate of 2% per month on the outstanding amount, and you may be liable for any debt collection costs.

5. Warranties and Guarantees

5.1 Service Warranty: We offer a warranty period of 3 months for certain Services (e.g., general pest control). If Pests reappear within this period due to a failure of our treatment, we will provide a follow-up Service at no additional cost, subject to clause 5.2.

5.2 Warranty Conditions: The warranty applies only if:

  • You notify us of the issue within the warranty period.

  • You have followed all post-treatment instructions provided by us.

  • The reappearance of Pests is not due to environmental factors, poor hygiene, or failure to address entry points beyond our control.

5.3 No Guarantee of Pest-Free Premises: Due to the nature of pest behavior and environmental conditions, we cannot guarantee that your Premises will remain pest-free indefinitely.

5.4 Australian Consumer Law: Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a refund or replacement Service for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Services performed with acceptable care and skill.

6. Liability

6.1 Limitation of Liability: To the maximum extent permitted by law, our liability for any loss or damage arising from the Services is limited to the cost of the Services provided. We are not liable for indirect or consequential losses (e.g., loss of profits, damage caused by Pests).

6.2 Your Responsibility: You are responsible for any loss or damage caused by your failure to provide accurate information, follow instructions, or ensure safe access to the Premises.

6.3 Pre-Existing Damage: We are not liable for any pre-existing damage to your Premises or property unless directly caused by our negligence during the Service.

7. Safety and Health

7.1 Chemicals and Treatments: We use safe, industry-approved chemicals and methods. You must inform us of any allergies, health conditions, or concerns (e.g., pets, pregnancy) prior to the Service.

7.2 Post-Treatment Safety: You agree to follow all safety instructions provided by us after the Service (e.g., vacating the Premises for a specified time, ventilating the area).

7.3 Risks: You acknowledge that pest control involves inherent risks (e.g., chemical exposure, structural disturbance), and we will not be liable for any harm caused by your failure to follow our instructions.

8. Intellectual Property

All materials, techniques, and processes used in providing the Services remain the intellectual property of Area Specialist Pest Solutions. You may not reproduce or distribute them without our written consent.

9. Privacy

We collect, use, and store your personal information in accordance with our Privacy Policy (available on our website) and the Privacy Act 1988 (Cth). Your information will only be used to provide the Services and communicate with you unless otherwise required by law.

10. Termination

10.1 By You: You may terminate this Agreement at any time by providing written notice. If Services have already commenced, you remain liable for fees incurred up to the termination date.

10.2 By Us: We may terminate this Agreement or refuse service if you fail to pay fees, breach these Terms and Conditions, or behave in a manner that endangers our staff.

11. Force Majeure

We are not liable for delays or failure to perform the Services due to events beyond our reasonable control, including natural disasters, strikes, or government restrictions.

12. Dispute Resolution

If a dispute arises, we will attempt to resolve it with you informally. If unresolved, the matter may be referred to mediation or arbitration in accordance with Australian law. This does not affect your rights under the Australian Consumer Law.

13. Governing Law

These Terms and Conditions are governed by the laws of New South Wales and Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of that state/territory.

14. Changes to Terms

We may update these Terms and Conditions from time to time. The current version will be available on our website, and continued use of our Services after changes constitutes acceptance of the updated terms.
